TERMS
AND CONDITIONS
The Terms and Conditions and all information contained
in this web site build up the basis of the contractual relationship
between Dragon (China) Tours & Travel and all its clients. Please
read these carefully. Receipt of a deposit will be taken as an understanding
by the Company that the participant has read and agrees to abide
by these terms and conditions.
PASSPORT & VISAS:
All passengers are reminded that a valid passport is necessary in
all cases. Visas are the responsibility of the traveler. We urge
you to check with all relevant consulates and/or embassies prior
to travel. Visas are required for China and we recommend these be
obtained with your Travel Agent assistance.
HEALTH: At the time
of printing, no vaccinations or inoculations are required. However,
we suggest you first check with the Department of Health for up-to-date
information.
TRAVEL INSURANCE:
We strongly recommend that you purchase a travel insurance policy
of your choice.
TRANSPORTATION AND ACCOMMODATION:
Whilst Dragon (China) Tours & Travel make every effort to ensure
accuracy in transport and accommodation information and descriptions,
we are reliant on our suppliers of transportation and accommodation
giving us accurate details. Since the suppliers are constantly changing
prices, facilities and services, we cannot be liable for any errors
or omissions herein. If during peak holiday periods we are unable
to confirm the transportation and accommodation specified, you will
be assigned a transportation and accommodation of similar or superior
standard.
TOUR PRICES: The prices
quoted by Dragon (China) Tours & Travel are subject to change
without notice in the event of unforeseen circumstances such as
fluctuation in exchange rates, fuel surcharges and land and airfare
costs. Itineraries are subject to alteration if airline schedules
are amended or other conditions require it.
BOOKINGS: Reservations
can only be confirmed upon receipt of a deposit of $150 per person
payable to Dragon (China) Tours & Travel together with a completed
and signed booking form and subject to availability. This deposit
is NON-REFUNDABLE if travel is not undertaken. The balance of payment
must be received 30 days prior to departure. If the booking is made
within 30 days of departure, then full payment is required immediately
upon such booking is confirmed.
AMENTMENT FEES: No
amendments to flight schedules can be made after tickets have been
issued within 21 days of departure. Any amendments to a confirmed
booking outside the above mentioned period will incur a fee of $50
per each amendment.
CANCELLATIONS: The
following cancellation fees or refunds shall apply if, for any reason,
the client cancels a holiday. All cancellation terms are specified
on a per person basis. LAND ARRANGEMENTS
- Bookings cancelled at any time after confirmation up to 30 days
prior to departure will be subject to a $100 per person cancellation
fee. Bookings cancelled at any time after confirmation within 30 days of departure will incur a
minimum fee of 70% per person for land cost and may forfeit any amount equal
to the total land content price. AIRFARES
- Where a cancellation occurs after ticket issued, a minimum of
25% of the applicable airfare may be retained by the airline. This
is an IATA regulation. All cancellations must be put in writing.
REFUNDS: No
refund is available after the holiday is commenced, or in respect
of any tours, accommodation, meals or other services not utilized.
LIMITATION OF LIABILITY:
Except to the extent that the law imposes a non-excludable liability:
Dragon (China) Tours & Travel (herein referred to as the Operator)
act only as an agent for the transportation services (airlines,
coach companies, rail roads, shipping companies), hotels and other
services and shall not assume any responsibility for loss, damage,
injury, accident, delay, changes in schedules, hotel overbooking
or other inconvenience to the passenger whether by reason of defect
in any vehicle or through acts of default of any company or person
engaged in conveying or housing the passenger. The Operator shall
not assume responsibility through acts of war, national disturbances
or causes of nature. The transportation companies, hotels and firms
shall be exempt from all liability in respect of any detention,
delay, loss, damage, sickness or injury, however or whom-so-ever
caused and what ever kind occurring on or to the passenger at any
time when the passenger is not on board a carrier or conveyance
used or operated by the transportation companies or hotels. The
Operator, its associate or agents, while taking every care with
the passengers? luggage or property, shall not accept any liability
for damage, loss or inconvenience in the handling thereof. The passage
contract in use by the transportation companies or firms concerned
shall constitute the sole contract between the transportation companies
or firms and purchaser of these arrangements and/or passengers.
LAW OF CONTRACT: Any
contract arising with the client shall be governed by the laws of
the state of Victoria and any legal action arising from there shall
be litigated only in the appropriate court having jurisdiction in
that State.
WEB VALIDITY: The
tours referred to in this web are valid from now to Year 2008.
